Commentary by Attorney Michael Grossman

When someone is seriously hurt in a single-vehicle crash, the immediate assumption tends to be that the driver simply lost control. But from my experience, those assumptions often miss the mark. To understand what really happened, there are three key questions that should always be asked.

First, did the authorities thoroughly investigate the crash? A proper investigation should go beyond noting that a vehicle left the roadway. It should include measurements of skid marks, examination of the roadway surface, and a close look at whether the driver may have tried to correct course or avoid an obstacle. Unfortunately, the level of detail in these investigations often depends on the time and resources available to local law enforcement, which can vary from one jurisdiction to the next.

Second, has anyone looked into the possibility of a vehicle defect? Sudden loss of steering control, a tire blowout, or a brake failure could all cause a vehicle to leave its lane and strike a fixed object. But unless someone preserves the vehicle and conducts a mechanical inspection, those potential causes may never be discovered. Too often, vehicles involved in single-car crashes are quickly towed away or scrapped before anyone has the chance to ask the right questions.

Finally, has all the electronic data from the vehicle been collected? Many modern vehicles, including SUVs like the Highlander, are equipped with event data recorders. These devices can reveal valuable information—like whether the driver was braking or steering, the speed of the vehicle, and more—leading up to the crash. That data can make the difference between understanding what actually happened and settling for guesswork.

Understanding how and why a crash happened is essential—especially when someone has been seriously hurt. The answers don’t always come easily, but they can’t be found unless the right questions are pursued from the start. Asking these questions is the least that can be done to ensure that those affected by this crash get the clarity and closure they deserve.
