Commentary by Attorney Michael Grossman
When a motorcycle goes down without any other vehicles involved, the report often ends with “loss of control.” But that phrase doesn’t explain why control was lost, and without deeper investigation, the real cause may never be known.
1. Did the authorities thoroughly investigate the crash?
A motorcycle crash on an open roadway leaves behind evidence that can tell an important story. Skid marks, the angle of departure, and the Harley Davidson’s final position can show whether the rider tried to brake, swerve, or suddenly lost stability. If investigators don’t reconstruct those details, the explanation risks being oversimplified.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
Mechanical issues can destabilize a motorcycle instantly. A tire blowout, brake imbalance, or suspension failure could have forced the rider off the road with little warning. If the Harley wasn’t carefully inspected before being cleared from the scene, the opportunity to identify such problems may already have been lost.
3. Has all the electronic data relating to the crash been collected?
Some motorcycles log limited performance data, and rider phones, GPS units, or helmet cameras may hold useful information about speed, braking, or steering inputs. If this evidence isn’t preserved, investigators are left without key context about how the crash unfolded.
Single-vehicle motorcycle wrecks may appear simple, but the underlying causes are often more complex. The real answers depend on whether investigators look closely at both the rider’s actions and the machine’s condition.
Takeaways:
- It’s not clear whether investigators reconstructed the motorcycle’s path before it overturned.
- A possible tire, brake, or suspension failure may not have been ruled out.
- Digital evidence from devices or the bike itself could provide key details if reviewed.
