Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that I hope investigators are taking the necessary steps to fully understand what happened. Motorcycle crashes are often assumed to be the result of rider error, but experience has shown me that many factors can contribute to an accident. That’s why any thorough investigation must address three critical questions.
First, did the authorities conduct a thorough investigation? The report states that the rider laid his motorcycle down to avoid an animal, but confirming the exact sequence of events is crucial. Were there any skid marks or debris that indicate how and where the crash occurred? Did investigators check the area for any surveillance cameras or nearby witnesses who might provide additional details? Roadway conditions also play a significant role in motorcycle crashes: was the surface uneven, covered in debris or poorly lit? Without answering these questions, important details might be overlooked.
Second, has anyone considered whether a vehicle defect played a role? The 2000 Kawasaki KM100 is an older motorcycle, and mechanical failures become more likely as vehicles age. A sudden issue with the brakes, throttle or steering system could have contributed to the crash. Did the rider attempt to brake, only to find the motorcycle unresponsive? Did the tires lose traction unexpectedly? A forensic examination of the bike could help determine whether a mechanical failure influenced the crash, but unfortunately, this step is often skipped.
Lastly, has all the electronic data from the crash been preserved? While motorcycles don’t always have the same level of onboard diagnostics as modern cars, some do record key performance data. Additionally, helmet cameras or nearby traffic cameras might provide crucial visual evidence of what happened. If the rider was wearing a smartwatch or another device that tracks movement, that data could also offer insights into the speed and trajectory of the motorcycle before the crash. However, if this information isn’t gathered quickly, it may be lost.
At the end of the day, motorcycle crashes deserve the same level of scrutiny as any other serious accident. Those involved deserve clear answers about what happened, and the only way to provide those answers is by ensuring a thorough investigation, considering possible mechanical failures and preserving all available data. The least the community can do is ensure that every effort is made to determine exactly what led to this crash.
