Commentary by Attorney Michael Grossman
It’s unfortunate how many people continue to drive around without keeping an eye out for bikers and others on smaller vehicles. That said, a lot of people are biased against motorcyclists, and police blaming a car driver isn’t necessarily going to make things open-and-shut.
Seeing responsibility for harm done to riders usually goes through insurance companies, and they know better than anyone that they can exploit people’s negative biases to try to minimize their responsibility. I’ve had countless cases where it took investigations far beyond what police initial did on their own to make sure insurance companies couldn’t blame a motorcyclist for something that wasn’t their fault.
As always, having as much evidence as possible is strong tool for victims and families looking to tell their side of the story. I doubt this crash will prove to be the exception.
