Commentary by Attorney Michael Grossman
Failure to yield is obviously negligent, but that doesn't necessarily make a crash investigation open-and-shut. There still has to be consideration for road conditions, lighting and signage, vehicle maintenance, potential defects, drugs or alcohol, distraction, medical conditions, etc. If authorities took the time to consider all of these factors, they've likely been able to get a lot of clear evidence.
In my experience, though, it's important to follow up with authorities just in case they instead rushed through the investigations. For people to get a fair resolution after a serious accident, it's important for them to get all the facts. If authorities don't do that, then it's important that independent investigators step in as soon as possible to pick up the slack.
