Commentary by Attorney Michael Grossman
With pedestrian accidents, people sometimes believe one of two misconceptions: They either assume pedestrians always have the right-of-way, or they assume drivers are only at fault if a pedestrian was in a crosswalk. The truth lies more in the middle.
Usually, the key factors are visibility and how reasonably avoidable a collision was. If, for example, someone is in the middle of the road, but they're clearly visible and far away enough for a reasonably prudent driver to avoid, a driver wouldn't suddenly be entitled to hit them just because the pedestrian didn't have the right-of-way. However, if a driver couldn't have reasonably seen and avoided the pedestrian, then it would be ridiculous for them to be held accountable for that.
I certainly can't say how things played out here without further investigations. That's why it's important there is always a complete understanding of the facts after crashes like this before anyone starts jumping to conclusions.
