Commentary by Attorney Michael Grossman
When people hear about a crash between a car and an 18-wheeler, especially one that leaves someone critically injured, the first question they tend to ask is, “Was the truck driver at fault?” That’s a fair question, but it’s only the starting point. To truly understand what happened, we need to dig deeper: What led to the collision? Was the truck in motion or stopped? Who had the right of way? Unfortunately, based on what’s publicly available so far, none of those questions have been answered.
Depending on how the vehicles collided, very different issues could be in play. If the truck crossed into the car’s path, we’d want to know why. Was the driver distracted: on a phone, dozing off or fumbling with in-cab electronics? That’s something that can be checked through ECM (engine control module) data, in-cab camera footage or even cell phone records. But if the car struck a turning truck, the timing and visibility of that maneuver become key. In either scenario, physical evidence from the crash scene, like skid marks, vehicle positions and damage patterns, will play a critical role in reconstructing what happened.
What concerns me most at this stage is how little information authorities have released. When a crash involves a commercial truck, there’s a risk that key facts get lost in the shuffle or never see the light of day unless someone demands them. I’ve worked cases where it wasn’t until we subpoenaed company records that we learned a driver had multiple past violations or was working excessive hours in violation of federal rules. And sometimes, it’s not just about the driver; it’s about the trucking company’s training, hiring policies or the pressure they put on drivers to meet unrealistic schedules.
We can’t yet say who’s responsible for this crash on Talley Road. But we can say with certainty that someone needs to find out, and that means collecting hard evidence while it’s still fresh.
Key Takeaways:
- Authorities haven’t released basic facts about how the crash happened or who was at fault.
- Critical questions include whether the truck was moving or stopped, and who had the right of way.
- Evidence like dash cam footage, black box data and cell phone records could clarify the truck driver’s actions.
- Trucking company policies and driver history often play a hidden but important role in these incidents.
- A full investigation is the only way to determine who should be held accountable.
