Commentary by Attorney Michael Grossman
With any serious crash, those affected are going to be looking for answers. The issue is that many end up waiting around for the authorities only to find those efforts come up short. One of the most common concerns people call me to ask about is how they can be sure their situation is being handled properly. Generally speaking, I've found these key questions can help in that regard.
Did investigators take the time and use the right tools to thoroughly examine the crash? Intersection collisions require careful analysis of traffic signals, vehicle positioning, and possible evasive actions. If authorities rushed through their review or lacked the resources for a full reconstruction, important details—such as visibility issues or road conditions—may have been overlooked.
Did they check whether a vehicle defect played a role? Brake failures, steering malfunctions, or acceleration issues could have contributed to the crash. Additionally, if seatbelts or airbags didn’t function properly, the severity of injuries may have been worse than necessary. Were the vehicles thoroughly inspected before crucial evidence was lost?
Did they preserve all available electronic evidence? The vehicles’ Engine Control Modules (ECMs) may contain key data on speed, braking, and steering inputs before impact. GPS records, cellphone data, and traffic or security camera footage could also provide valuable insights. Did investigators take steps to secure this information before it was lost or overwritten?
It might surprise people how often authorities come up short when answering these questions. Of course, there are times they meet or surpass expectations, and they show their investigations have been thorough. But if victims or families feel unsatisfied with the responses they get, that can be an opportunity to have independent professionals look into things so they know nothing important is being overlooked.
