Commentary by Attorney Michael Grossman
With authorities suggesting the possibility of alcohol here, it’s important to consider how thorough investigations have been. I’ve seen far too many situations where authorities put all of their focus on a potentially intoxicated driver, but they never consider where the alcohol came from. In Texas, alcohol providers can also be responsible for contributing to deadly accidents, yet they too often fly under the radar.
Simply put, it’s unlawful for bars and similar establishments to over-serve someone who is obviously intoxicated. Doing so can expose the establishments to potential criminal investigations, fines, or liability for deaths or injuries caused by that intoxicated. This helps to ensure both that there is accountability after a fatal crash and to get those negligent alcohol providers to clean up their act before more people get hurt.
Like I said, though, this too often goes overlooked. It’s possible that authorities here have been working behind the scenes to retrace the driver’s steps prior to the accident. If their efforts began and ended at the crash scene, though, there may yet be more to the story the victim’s loved ones deserve to hear.
