Commentary by Attorney Michael Grossman
Situations like the one reported here tend to bring up concerns about how thorough investigations have been. People may see that authorities blamed a truck driver for their behavior, and they figure that makes things open-and-shut. Well, not only is that just one potential factor involved in the accident, but also it doesn’t explain why that mistake happened in the first place. Let me explain why that’s important.
Let’s say evidence shows that a truck driver backing unsafely was the cause of this accident. Was that just an isolated incident or rather the result of a series of negligent decisions? I’ve handled hundreds of commercial vehicle accident cases, and employers often contribute to accidents through their own behavior. A driver backing unsafely, for example, could be the result of poor training. It could be a driver rushing to meet unreasonable deadlines. It could even be that a driver had a history of reckless behavior, but they were hired anyway due to a company prioritizing getting trucks moving over making sure their employees can do their jobs safely.
By investigating these kinds of possibilities, two key things can be accomplished. One, families can be certain that those responsible for the accident are held appropriately accountable for their actions. Two, steps can be taken to weed out any underlying issues which, if left unchecked, could lead to others getting hurt in the future. That’s why, despite the serious accusations in these preliminary reports, I have to wonder if authorities worked to get the whole story here.
