Commentary by Attorney Michael Grossman
Something that comes to mind reading about this is the importance of making sure authorities were thorough and unbiased in their investigations immediately following the accident. To be rather frank, it's prudent to have some healthy, reasonable skepticism about a situation where a seriously injured victim may not have been around to tell their side of the story, but the driver of a commercial vehicle was. Let me explain.
Regardless of who or what causes a crash, a truck driver's employer has one priority: avoid responsibility. It's really quite shocking the lengths to which some companies go to accomplish this goal. I've handled hundreds of commercial vehicle accident cases, and many involved unscrupulous companies who did everything they could to influence how an investigating officer viewed a crash. There was even one case where they flew a defense lawyer to the accident scene within minutes of the accident.
There are certainly experienced, unbiased officers who know that the evidence should have the final say on what happened. However, there are also many inexperienced, ill-equipped, or simply busy officers who make mistakes. That's why it can be crucial to follow up with them and ask them questions about their investigations. That way, if those answers aren't encouraging, steps can be taken to have independent investigators look into the accident more thoroughly.
