Commentary by Attorney Michael Grossman
When a pedestrian is fatally struck in the early morning hours, especially outside of a crosswalk, many people assume the outcome was inevitable. But in my experience, assumptions like that often prevent us from asking the more important questions that help explain how a crash really happened. To understand whether this incident could have been prevented, there are three critical questions that should be asked.
First, did the authorities thoroughly investigate the crash? At that hour, visibility and environmental factors can play a role, but so can decisions made by drivers and pedestrians alike. A thorough investigation should include not only a review of the scene, but also interviews with potential witnesses, evaluation of physical evidence, and consideration of contributing circumstances. Unfortunately, not all investigations are equally resourced or detailed, and that can leave important facts undiscovered.
Second, has anyone looked into whether a vehicle defect could have contributed to the crash? Even something as seemingly straightforward as a pedestrian collision could involve issues with headlights, brakes, or steering components. If any of those systems malfunctioned, it could explain a driver’s inability to avoid a collision. These kinds of problems are only found through a careful inspection of the vehicle—something that can only happen if the vehicle is preserved and reviewed promptly.
Lastly, has all the electronic data related to the crash been collected? Most newer vehicles contain onboard systems that store valuable pre-crash data, including speed, braking activity, and steering input. That information can help determine whether the driver reacted appropriately or whether the vehicle itself failed to respond as expected. Surveillance footage or traffic cameras in the area may also offer additional insight into how the collision occurred.
When a person loses their life and the cause remains uncertain, a complete and timely investigation is essential. Asking these questions is the least that can be done to ensure that those affected by this crash get the clarity and closure they deserve.
