Commentary by Attorney Michael Grossman

When someone is seriously injured while on foot in the roadway and the driver responsible leaves the scene, it’s easy to focus solely on the hit-and-run aspect. But in my experience, the real work lies in understanding how the collision occurred in the first place. To do that, there are three essential questions that should be asked.

First, did the authorities thoroughly investigate the crash? At 3:30 in the morning, visibility is naturally low, and it’s critical that investigators examine not just the point of impact, but also lighting conditions, vehicle debris, witness statements, and any surveillance footage from nearby businesses. In hit-and-run cases, especially those that occur in commercial corridors like this one, every effort should be made to identify the fleeing vehicle and reconstruct the chain of events.

Second, has anyone considered whether a vehicle defect could have played a role? While it’s true the driver fled, which strongly suggests some form of misconduct, it’s still possible that a mechanical issue—such as inoperable headlights or steering failure—contributed to the crash. These factors often go unexamined, especially if the vehicle is not recovered quickly, but they are no less relevant to understanding the full scope of what happened.

Lastly, has all available electronic and video data been preserved? Surveillance footage, nearby traffic cameras, or even dashcams from passing vehicles could be vital in identifying the vehicle and piecing together exactly how the collision occurred. In addition, if the suspect vehicle is located later, its event data recorder could provide key details about speed, braking, and steering inputs in the moments leading up to impact.

When someone is struck in the roadway and the responsible party flees, it’s not enough to hope they’ll be held accountable later. We also need to ask the right questions now to ensure the full story comes to light. Asking these questions is the least that can be done to ensure that those affected by this crash get the clarity and closure they deserve.
