Commentary by Attorney Michael Grossman
When a vehicle leaves the roadway without warning, there’s usually more to uncover than what’s visible in the aftermath. The steps taken in the early hours of an investigation can make all the difference in determining why it happened.
1. Did the authorities thoroughly investigate the crash?
It’s important to know if investigators examined the full path the truck and trailer traveled before impact. Trailer sway, shifting cargo, or driver reaction to a sudden event could have played a role. A detailed scene analysis, including measurements and photographs, can help ensure no small but critical details are missed.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
A mechanical problem—whether with the pickup or the trailer—can cause a loss of control quickly. Brake failures, steering issues, or even a hitch malfunction should be considered, especially in a case where no other vehicles were involved.
3. Has all the electronic data relating to the crash been collected?
If equipped, the truck’s event data recorder could provide information about speed, steering inputs, and braking right before the collision. Any GPS data from the vehicle or trailer tracking system might also help clarify the sequence of events.
As with many single-vehicle incidents, the real story often lies in the details that aren’t visible at first glance, making thorough follow-up work essential.
Takeaways:
- Loss of control in a truck-and-trailer combination can stem from both vehicle and trailer factors.
- Mechanical inspections are key when no other vehicles are involved.
- Electronic data can fill in the final moments leading up to impact.
