Commentary by Attorney Michael Grossman
If allegations of drunk driving here are true, that wouldn't be at all unusual. That's almost always the primary factor in someone driving the wrong way. It raises serious concerns that the person may have been unlawfully over-served by a bar or other alcohol provider. That could mean there is actually a negligent alcohol provider responsible for contributing to the accident.
Simply put, bars and similar establishments in Texas can be held accountable if they serve someone who is obviously intoxicated. That could be through criminal investigations, administrative penalties or fines, or even liability for the resulting injuries or deaths.
Too often though, authorities overlook this. If their efforts don't extend beyond a crash scene, they could end up letting a negligent alcohol provider fly under the radar. That only allows the negligent establishment to continue their reckless behavior until more families lose their loved ones because a driver the establishment over-served got behind the wheel. Are authorities here being more diligent to ensure there will be appropriate consequences for this accident?
