Commentary by Attorney Michael Grossman
It's unclear if any charges were filed here, but frankly that wouldn't surprise me. To be clear, I can't say what exactly happened here. For all I know, the truck experienced sudden brake failure due to a defect. Is that possible? Sure. Is it likely? Not at all. It's far more likely this guy screwed up.
Rear-end collisions are all too common, and the fact of the matter is they almost always involved speeding, following too closely, poorly maintained vehicles, or distraction (to no one's surprise). As simple as that may sound, however, one of the reasons I get so many incidents similar to this one on my desk is because folks don't realize just how much problem insurance companies can cause even after crashes which seem about as straight-forward as they could possibly be. That's one of the reasons it's in people's best interest to ensure they have the tools, allies, evidence, and dedication to overcome those barriers.
