Commentary by Attorney Michael Grossman
When folks see accidents like this, it may seem as simple as determining who had the right-of-way. However, it’s important to gather as much evidence as possible to find out not just what happened but also why it happened. Especially with commercial vehicles, that can be a significant challenge authorities aren’t always up to.
For example, I handled a case not long ago where a truck driver was texting and driving, and authorities basically saw the collision as open-and-shut. Our investigations went beyond the crash scene, though, and we found out mistakes made long before the driver got behind the wheel ultimately led to the collision. It turned out the driver was responding to his supervisor. This supervisor would constantly micromanage drivers throughout the day, texting and calling incessantly. If drivers failed to respond immediately, they risked getting in trouble. Naturally, this led to drivers taking risks behind the wheel, and it was just a matter of time before people got hurt.
What authorities wrote off as a simple case of driver error turned out to be a whole company putting lives at risk. When authorities fail to give serious accidents proper attention, important details like that can easily slip through the cracks. Now, I’m not saying anything like that led to this accident, but it’s important to ensure investigators are at least ruling out these possibilities. If nothing else, there’s likely a family out there who deserves answers.
