Commentary by Attorney Michael Grossman
A key factor will no doubt concern what was meant by the commercial vehicle "stopping" on the highway. Was it just slowing for traffic or to make a turn? Those are reasonable things to do, and a driver wouldn't really be able to see a deadly collision resulting from those routine actions. But there can be situations where a commercial vehicle stops for unacceptable reasons or in a manner that is dangerous. This could involve mechanical issues relating to poor maintenance, running out of gas, crashing or losing control, or failing to ensure a vehicle is properly marked in a reasonable amount of time after some sort of breakdown. Right now, it's unclear how all of this will pan out, so it's important to wait for the evidence to show exactly what went wrong here.
