Commentary by Attorney Michael Grossman
Authorities say that the Mercedes-Benz driver may have been under the influence at the time of the accident. This has yet to be confirmed. It's not clear if authorities are waiting on toxicology results or perhaps hospital records. But there are other forms of evidence that can prove if someone was drunk at a given time.
Our firm has to prove intoxication frequently, which we've done hundreds of times when handling personal injury cases against negligent alcohol providers. To show they over-served the driver who caused the accident, we can use things like credit card statements and receipts, surveillance video, witness testimony, texts, and even social media posts. Even without something as important as a BAC result, that evidence can help to determine if an individual was intoxicated. Are authorities looking into those possibilities here?
