Commentary by Attorney Michael Grossman
One of my concerns with any accident like this is people sometimes take a stalled vehicle to be a sign that any resulting accident was simply unavoidable. However, it's still important to gather evidence to create a clear reconstruction of the circumstances and conditions surrounding the accident.
For example, if someone is standing outside of a stalled vehicle, but they're safely on the shoulder, it would raise concerns if another driver left their lane and hit them. Or, even if they are in a lane of travel, what if they're clearly lit and visible? Most reasonable drivers would be able to slow down or go around them. A driver failing to do so would raise red flags.
Just to be clear, those are examples. Authorities haven't confirmed exactly how avoidable any of this was or if the victim was clearly visible to approaching traffic. But if this accident is simply written off as unavoidable before all the facts are brought to light, it would be a serious disservice to the victim's loved ones, who at least deserve to know they're getting the full story.
