Commentary by Attorney Michael Grossman

When accidents like this occur, especially those involving a fatality and serious injuries, it is critical to conduct a thorough investigation to determine how and why the crash happened. In my experience, understanding the contributing factors behind a collision like this requires a careful focus on three critical questions.

First, did the authorities thoroughly investigate the crash? Head-on collisions often require detailed reconstruction to establish the sequence of events. Investigators should examine physical evidence, including tire marks, debris patterns, and the final resting positions of the vehicles, to determine how the Silverado crossed into the oncoming lane. Witness statements and any available footage from nearby cameras or dashcams could also provide valuable insights into the actions of both drivers and the moments leading up to the crash.

Second, has anyone considered whether a vehicle defect might have played a role? Mechanical issues, such as steering malfunctions, brake failures, or tire blowouts, could explain why the Silverado veered out of its lane. Similarly, the Ford F-350 should be examined to ensure its safety systems, such as seat belts and airbags, operated as intended to protect its occupant. A forensic inspection of both vehicles is necessary to rule out or confirm mechanical problems that may have contributed to the collision or its severity.

Finally, has all relevant electronic data been collected? Both the Chevrolet Silverado and Ford F-350 are likely equipped with event data recorders (EDRs) that capture critical information such as speed, braking, and steering inputs leading up to the crash. This data can clarify whether the Silverado’s movements were consistent with driver input or indicative of a mechanical failure. Surveillance footage, if available, could further shed light on the circumstances of the collision. Securing this evidence promptly is vital to preserving key details.

Head-on collisions involving vehicles crossing into opposing lanes are often complex and require thorough investigation to uncover all potential contributing factors. By addressing these key questions, investigators can work toward providing a clearer understanding of what happened and why. For the loved ones of the man who lost his life and for Roy Choate as he recovers, obtaining these answers is a necessary step toward understanding and closure. A comprehensive investigation is the least that can be done to ensure every possible factor is carefully examined.
