Commentary by Attorney Michael Grossman

In all the chaos that follows a car accident, it’s understandable that people might not be immediately thinking of investigations. After all, police handle all of that, right? Well, sometimes they’re not as thorough as people would expect. It can be crucial, then, to follow up with them and ask a few key questions.

Did authorities have the time, tools, and training to properly analyze the crash? High-speed collisions on busy highways require careful reconstruction, but if resources were limited or the investigation was rushed, critical factors—such as vehicle positioning, traffic conditions, and potential evasive maneuvers—may not have been fully examined.

Did investigators consider whether a vehicle defect contributed to the crash? Mechanical failures like brake malfunctions, steering issues, or even safety system failures could have played a role. If seatbelts or airbags didn’t function properly, injuries may have been more severe than necessary. Were the vehicles thoroughly inspected before crucial evidence was lost?

Did authorities collect and preserve all available electronic evidence? Both vehicles’ Engine Control Modules (ECMs) could provide data on speed, braking, and steering inputs before the crash. GPS records, cellphone activity, and any nearby traffic cameras or surveillance footage could also offer valuable insights. Have investigators secured this evidence before it’s lost or overwritten?

These questions give authorities an opportunity to provide answers and show they did good investigations. However, if victims or families find their answers to be lacking, that can be their sign that the accident may need a second set of eyes looking things over. That way, nothing important slips through the cracks.
