Commentary by Attorney Michael Grossman
When someone is seriously hurt in a suspected drunk driving crash, most people naturally focus on the driver who caused the wreck. But in cases like this, it’s just as important to ask a broader question: How did the driver end up in that condition in the first place?
Authorities suspect the GMC driver was intoxicated at the time of the crash, which seriously injured another motorist. That alone warrants a deeper look not just at the crash scene, but at what happened in the hours leading up to it. Specifically, was the driver drinking at a bar or restaurant that overserved them?
Under Texas dram shop laws, it’s illegal for alcohol providers to serve someone who is obviously intoxicated. When they ignore that rule and someone ends up hurt, the provider can be held accountable. That’s not about casting a wider net for blame: it’s about recognizing that public safety depends on responsible alcohol service.
Crashes like this rarely come out of nowhere. More often than not, there’s a chain of decisions that led to the outcome, and it’s critical to find out whether an alcohol provider was part of that chain.
From where I sit, getting answers about where the drinking occurred is just as important as understanding what happened on the road. That’s how accountability works, and it’s how we make sure the same thing doesn’t happen again.
