Commentary by Attorney Michael Grossman
When a vehicle crashes into a tree and rolls over, especially in the early hours of the morning, it’s often written off as driver error or fatigue. But serious injuries in a single-car crash raise a deeper question: was the driver in control—or did the vehicle take that control away?
Did the authorities thoroughly investigate the crash?
Any time a vehicle leaves the roadway and overturns, the scene should be fully reconstructed. Did investigators analyze whether the driver attempted to brake or steer before impact? Was speed estimated based on debris, damage, or tire marks? A crash like this could result from a moment of inattention—or from a split-second mechanical issue. Without detailed documentation, it’s impossible to tell the difference.
Has anyone looked into the possibility that a vehicle defect caused the crash?
The Kia Sportage, like many modern SUVs, includes multiple systems meant to help keep it stable and controllable. If the steering failed, a tire blew out, or the electronic stability control system malfunctioned, the vehicle could veer off the road without warning. These issues are often invisible to the naked eye and require a targeted mechanical and electronic inspection to uncover. If the vehicle wasn't reviewed carefully, the root cause may already be overlooked.
Has all the electronic data relating to the crash been collected?
The Sportage likely contains an event data recorder that tracks speed, throttle, brake use, and steering input leading up to a crash. This kind of information is crucial for confirming whether the driver made any corrective actions—or whether the vehicle responded as expected. GPS data and phone usage may also offer additional context. But this data must be retrieved early before it's lost or overwritten.
A crash that ends in a rollover and serious injury shouldn’t be brushed off as an accident in the dark. What happened in those final seconds matters—and the answers are there for anyone willing to look past assumptions.
Takeaways:
- Rollover crashes on highways require full reconstruction to determine vehicle movement and driver response.
- Mechanical failures in steering, tires, or stability systems must be inspected to rule out unexpected causes.
- Vehicle data can show whether the driver reacted—and whether the vehicle responded correctly.
