Commentary by Attorney Michael Grossman
After any serious accident, there’s often a rush to explain what happened, but the early answers don’t always tell the whole story. Especially in single-vehicle crashes, it’s important to pause and ask whether all the right questions were asked, or if deeper truths might still be uncovered.
Did the authorities thoroughly investigate the crash? When a crash happens in the early morning hours on a highway exit, fatigue, distraction or even mechanical problems might come into play. But understanding the true cause starts with how thoroughly investigators examined the scene. That means more than just documenting the damage. Did they take measurements, map out the vehicle’s trajectory or look into the driver’s movements leading up to the crash? Some departments have the resources and training to dig deep. Others may rely on more basic reviews that leave important details out.
Has anyone looked into the possibility that a vehicle defect caused the crash? A relatively new vehicle colliding with an attenuation device raises some fair questions about whether something in the car malfunctioned. Were the brakes working properly? Could a steering issue or sensor error have played a role? Mechanical failures don’t always leave visible evidence, and if no one conducts a full inspection of the Jeep, those potential problems could be missed entirely.
Has all the electronic data relating to the crash been collected? Modern vehicles carry digital records of how they were being driven in the moments before impact: speed, braking, steering input and more. Did investigators download that information from the vehicle? Was there any phone use detected, or GPS data that could show how the car approached the exit? When electronic data gets overlooked, the picture of what really happened remains incomplete.
As time passes after a crash, memories fade and physical evidence can disappear. That’s why it matters so much to go beyond the surface right away. When investigators ask the right questions and gather the full picture, it doesn’t just explain a single incident; it helps everyone understand how to prevent the next one.
Key Takeaways:
- Not all crash investigations go far enough to uncover what truly happened.
- Mechanical problems in newer cars can still occur and need to be ruled out.
- Vehicle and phone data offer clear insight, but only if someone collects it.
