Commentary by Attorney Michael Grossman
When a moving vehicle collides with a parked one and ends up overturned, there’s a strong suggestion that something sudden and unexpected happened. But until the full cause is known, it’s critical to ensure that no angle is overlooked—especially in a crash where a life was lost.
Did the authorities thoroughly investigate the crash?
A single-vehicle crash involving a rollover should always prompt close examination. Investigators should have reviewed the Dodge’s path leading up to the collision, measured distances, and assessed whether braking or evasive actions were taken. They should also analyze whether speed, distraction, or impairment played a role. If those elements weren’t carefully documented at the scene, vital clues about what triggered the impact—and the rollover—may have already been lost.
Has anyone looked into the possibility that a vehicle defect caused the crash?
When a driver hits a parked car and the vehicle flips, mechanical issues have to be considered. A failure in the steering system, a brake malfunction, or even a suspension problem could make the vehicle difficult or impossible to control. Without a thorough post-crash inspection of the Dodge Dakota, there’s no way to rule out whether the vehicle itself contributed to the crash—or whether something failed at the worst possible moment.
Has all the electronic data relating to the crash been collected?
The Dodge likely contained electronic systems that captured key data in the seconds before the crash. Information such as speed, brake pressure, steering input, and whether safety systems were active can provide an accurate snapshot of what really happened. This data is especially important in overturn scenarios, where driver response and vehicle stability can mean the difference between a near miss and a fatal outcome. If that data hasn’t been reviewed, investigators may be relying on incomplete evidence.
When a parked vehicle is struck and a rollover follows, there’s more at stake than just knowing who was in the car. The real issue is whether the vehicle behaved as expected—and whether anything more could have been done to prevent a death.
Key Takeaways:
- Electronic vehicle data can confirm driver inputs and system behavior leading up to the crash.
- Crashes involving parked vehicles and rollovers demand detailed scene reconstruction and speed analysis.
- Mechanical failures should always be ruled out with a post-crash inspection.
