Commentary by Attorney Michael Grossman
When a crash involves an 18-wheeler with heavy front-end damage and someone is sent to the hospital, the key question isn’t just what happened, but why it happened. In my experience handling truck accident cases, wrecks like this are rarely the result of a single, isolated mistake. More often, they stem from a combination of poor decisions, overlooked risks, or unsafe conditions that build up until something goes wrong.
What led to the collision in the first place? Front-end damage to an 18-wheeler usually indicates that the truck struck something—possibly another vehicle that slowed or stopped unexpectedly. Was the truck following too closely? Did the driver fail to see the hazard in time? Was the truck going too fast for the traffic conditions? Investigators will need to review black box data, dashcam footage, and crash scene evidence to determine what events set this wreck in motion.
Was the 18-wheeler being operated for commercial purposes? If it was, that means the driver and the company behind the wheel both had added responsibilities under the law. Commercial operators are required to follow strict safety rules—including limits on driving hours, maintenance requirements, and training standards. If the trucking company didn’t ensure its driver was rested, prepared, and operating a safe vehicle, that failure may have played just as much of a role in the crash as anything that happened on the road.
What condition was the truck in at the time of the wreck? A vehicle with brake or steering issues can quickly become impossible to control—especially in an emergency. Investigators should take a close look at recent inspections, repair history, and whether the vehicle had any outstanding mechanical problems. A well-maintained truck should be able to stop in time to avoid a collision. If it couldn’t, there needs to be a clear explanation for why.
At the end of the day, the most important thing is finding answers. Even if it takes an independent investigation to gather the right evidence, it’s critical to examine every factor to ensure those affected by the crash get the clarity they deserve.
