Commentary by Attorney Michael Grossman
In reviewing this crash, the key issue is determining why the bus pulled into the path of the semi-truck, as reported. Collisions involving large vehicles can result in complex investigations due to the number of factors and people involved. This case is no exception, particularly with the bus carrying multiple minors and the truck overturning after the impact.
The primary focus of the investigation should be on why the church bus entered the intersection. Did the bus driver fail to yield the right of way? Was there confusion about traffic signals or signage at the intersection? Clear evidence, such as witness statements, traffic camera footage or police reports, will be necessary to establish whether the bus driver made a judgment error.
Understanding the decisions made by both drivers is critical. Investigators should explore whether the bus driver was distracted, fatigued or under pressure to adhere to a schedule. Similarly, they should assess whether the truck driver was traveling at a safe speed, particularly given the truck was hauling cattle, which affects vehicle stability.
The semi-truck's load of cattle raises unique concerns. Trucks hauling live animals often have a higher center of gravity, making them prone to overturning in a crash. Investigators should look into whether the truck was loaded correctly and whether the driver was operating it in a manner consistent with its unique handling characteristics.
The truck’s overturning after the crash suggests significant force was involved. Investigators should analyze how the truck’s movement after the collision contributed to the injuries of those involved. For example, did the truck’s trajectory create additional hazards, such as striking the bus a second time or blocking escape routes?
The church bus was carrying 14 minors. Investigators should examine whether all passengers were wearing seat belts and if the bus was equipped with adequate safety features. Similarly, the truck driver’s condition and the role of the truck’s cabin safety features warrant attention.
The intersection where this crash occurred deserves close examination as well. Were there adequate traffic controls, such as stop signs, yield signs, or lights? Could the layout or visibility at the intersection have contributed to the crash? Additionally, since the crash occurred in the evening, lighting conditions at the intersection may have played a role.
This crash highlights the complexities of managing large vehicles on the road, particularly at intersections where the margin for error is slim. If the investigation reveals deficiencies in road design, traffic control, or vehicle safety practices, those findings could inform efforts to prevent similar crashes.
While the immediate focus is on the injuries and ensuring everyone receives proper medical care, the investigation must go deeper to uncover the factors that caused this crash. A thorough review of the evidence — including traffic patterns, driver actions, vehicle conditions, and the design of the intersection — is essential to understanding what went wrong and ensuring that those involved receive the answers they need.
