Having handled hundreds of commercial vehicle accident cases, they're about as complex as an accident can get. The approach for victims and families, though, can be made a lot easier if they just know what questions to ask early on. These are some I ask after any serious truck wreck.
- Have officers been given the time and tools they need for a proper accident reconstruction?
Too many departments treat accident reconstruction as a low priority. This can leave even skilled and dedicated officers unable to do their jobs. That can lead to important information slipping through the cracks if steps aren't taken early on to fill in the gaps. - Are the vehicles being inspected for potential mechanical or safety feature defects?
Whether it's electrical issues, faulty crash avoidance systems, or mechanical failures due to mistakes from manufacturers, defects can easily cause or worsen serious accidents. Even if they're relatively uncommon, failing to look for them at all can be a sign investigations aren't being handled properly.
- Have authorities worked to secure all electronic data?
Most modern vehicles—especially commercial trucks—have Engine Control Modules (ECMs) which store vital data, such as braking, speed, or steering inputs. Cellphone records can reveal phone activity or GPS data. There may also be possible video evidence from cameras on the vehicles or at a nearby residence or business. This evidence can be absolutely crucial, but it's usually time-sensitive and needs to be secured promptly.
In my experience, the investigations that are able to satisfyingly answer these questions end up being very thorough. The investigations that come up short typically need independent investigators stepping in before evidence is lost. As such, families can consider these questions when they speak to authorities and determine what next steps are best for them depending on the responses.
