Commentary by Attorney Michael Grossman
When a utility vehicle overturns on private property, the explanation often stops at “loss of control.” But that description doesn’t explain why control was lost, and unless the investigation digs deeper, the real causes may never be understood.
1. Did the authorities thoroughly investigate the crash?
Even on private land, a rollover crash deserves a detailed review. Investigators should document the UTV’s path, tire marks, and resting position to understand whether the vehicle drifted gradually, swerved suddenly, or tipped due to terrain. Without this reconstruction, the event risks being written off without answers.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
UTVs are prone to stability issues because of their design, and a mechanical failure could easily make matters worse. A steering malfunction, brake issue, or suspension problem might have caused or contributed to the rollover. If the UTV was removed without a close inspection, potential evidence of a defect may already have been lost.
3. Has all the electronic data relating to the crash been collected?
Some UTVs are equipped with electronic systems that capture speed or performance data, and rider phones, GPS devices, or surveillance cameras on the property could also hold useful information. If that data isn’t collected promptly, important details about what really happened may remain unknown.
Single-vehicle crashes may look simple, but they rarely are. The answers depend on whether investigators examine every factor—from driver actions to vehicle condition—before the evidence disappears.
Takeaways:
- It’s unclear whether investigators reconstructed the UTV’s full path before the rollover.
- A possible steering, suspension, or brake failure may not have been ruled out.
- Electronic data and nearby cameras could provide key details if reviewed.
