Commentary by Attorney Michael Grossman
Any mention of alleged intoxicated driving is serious, and it's no surprise to see serious charges being reported. But those charges alone may not address all of the wrongs that led to this accident. For example, was alcohol the intoxicant? If so, there's a good chance that a negligent alcohol provider is also responsible for contributing to this accident.
Simply put, it's unlawful in Texas for alcohol providers to serve someone who is obviously intoxicated. Doing so means the bar or other establishment can be held accountable for their role in a resulting crash. However, this isn't something that gets a lot of attention. I've handled hundreds of cases against negligent alcohol providers. Too often, authorities go after the drivers, then move on without going beyond the crash scene.
At the end of the day, families deserve to know they're getting the whole story, and they deserve to know there will be full accountability for those who harmed them. That can't happen if investigators allow a local alcohol provider to continue putting the community at risk. That's why there may need to be further investigations here to find out if anyone else contributed to this senseless accident.
