Commentary by Attorney Michael Grossman
I have to wonder what more information authorities have looked into since this crash happened. When I see a vehicle is on the wrong side of the road, it raises serious red flags. It could be that the vehicle simply crossed over, which is often the result of things like distracted driving or fatigue. But if someone was simply on the wrong side of the road, that could be a sign they were intoxicated.
People might think that all means this situation is likely open-and-shut. But if alcohol contributed to the crash, it could lead to more thorough investigations into where the alcohol came from and if that driver was unlawfully over-served by a complicit alcohol provider. This is why I always discourage folks from jumping to conclusions or seeing an accident as straight-forward before all the facts are clear. There's no telling what more thorough investigations could reveal.
