Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that the person involved deserves clear answers about what happened. A tractor-trailer losing control and rolling over is not something that happens without a cause. While authorities continue their investigation, three key questions must be addressed to fully understand what led to this accident.
First, did law enforcement conduct a thorough investigation? Commercial truck accidents involve additional complexities compared to passenger vehicle crashes. Investigators should examine whether speed, shifting cargo, or road conditions played a role. Were there signs of braking or evasive action before the rollover? Were weather conditions or roadway design factors in the loss of control? A full accident reconstruction can help determine what led to the crash and whether additional safety measures could prevent similar incidents in the future.
Second, has anyone considered whether a mechanical failure or cargo issue contributed to the crash? Large trucks depend on properly maintained brakes, tires, and steering components to operate safely. A mechanical failure in any of these systems could cause a sudden loss of control. Additionally, improperly secured or imbalanced cargo can shift unexpectedly, making it difficult or impossible for the driver to maintain stability. Investigators should ensure that both the truck’s mechanical condition and cargo loading procedures are carefully examined before drawing conclusions.
Finally, has all available electronic data been preserved? Commercial trucks are equipped with electronic control modules (ECMs) that store critical crash-related data, such as speed, braking activity, and steering inputs. Additionally, many trucking companies install onboard cameras that may have captured footage of the crash. Investigators should also check for any available traffic camera or business surveillance footage. Another key piece of evidence is the driver’s records—was the driver fatigued from excessive hours on the road? Preserving these digital records is essential to understanding the full circumstances of the crash.
At the end of the day, crashes like this leave many unanswered questions. Understanding what caused the truck to lose control is essential—not just for those directly affected but for the broader community as well. A thorough investigation is necessary to ensure that no potential piece of evidence is overlooked in the search for the truth.
