Commentary by Attorney Michael Grossman
I've learned across hundreds of cases over 30 years that it's important to consider even unlikely possibilities following any fatal accident. People are too quick to jump to conclusions, and it often leaves families in a position where they feel they won't be able to get the answers they need unless they can find unbiased independent investigators who will look into evidence authorities may have overlooked.
For example, people reading that the victim's vehicle hit the rear portion of the truck here might believe the old misconception that someone who hits the back of another vehicle is automatically at fault. In reality, proper investigations would ask all kinds of questions a preliminary police investigation rarely digs into. Were the trucks taillights working? Did the victim's vehicle have faulty brakes or some other defect? Did this all happen due to an alcohol provider illegally over-serving someone? Are there issues with this specific stretch of road?
These are just a few examples of what more thorough accident reconstructionists investigate. Even if some of these possibilities are less common, they've happened plenty, and they're at least worth ruling out. Otherwise, there could be a family out there left questioning whether or not they're really getting the whole story.
