Commentary by Attorney Michael Grossman
When a dump truck collides with another vehicle, causing both to overturn, as described in this case on Sunrise Highway, the legal and investigative focus should be on what caused the initial collision and why the dump truck ultimately veered off the road. Accidents involving dump trucks are particularly complex because of the size, weight, and operational challenges of these vehicles, especially when they lose control.
Determining the cause of the crash is critical to understanding who may bear responsibility. Investigators should evaluate the speed and lane positioning of each vehicle prior to impact, using cell phone records, witness statements and toxicology results to determine if either driver made a sudden maneuver, such as changing lanes, failing to yield or stopping abruptly, that contributed to the collision. Authorities also should consider road conditions and potential mechanical issues. Did the dump truck experience a mechanical issue, such as brake failure or tire blowout, which caused the driver to lose control? A forensic examination of the truck’s braking system, tires, and other components will be critical.
Dump trucks are especially prone to rollovers due to their high center of gravity, particularly when loaded. Investigators need to consider whether the truck's load was properly balanced and secured, if the truck had to take evasive action and if the driver was adequately trained to handle emergency conditions. Commercial vehicle operators are expected to maintain control even in challenging situations.
Given the severity of this crash, it’s essential to investigate whether the dump truck was in safe operating condition. Mechanical failures, such as worn brakes or faulty tires, can cause or worsen accidents. Investigators should review the truck’s maintenance records to ensure it was properly inspected and maintained. Company oversight could be an issue as well. Did the truck’s owner or employer enforce proper safety protocols, including regular vehicle inspections and driver training? Companies that cut corners on maintenance to save costs may share liability if mechanical issues are found.
While details are limited at this stage, the severity of this crash warrants a thorough investigation. This should include accident reconstruction based on Engine Control Module data, vehicle inspections and witness statements and footage.
it’s critical not to make assumptions until all the evidence is in. The investigation must focus on understanding why the collision occurred and whether negligence — by the truck driver or the truck’s owner — played a role. Answering these questions is key to determining fault and ensuring accountability.
