Commentary by Attorney Michael Grossman
When reading about incidents like this, it’s important to consider not just the immediate details but the broader context of how and why such crashes occur. Authorities allege that the driver of the Buick Envision was intoxicated at the time of the crash, which raises significant questions about where she had been and how she came to be in that condition.
One crucial aspect of any investigation into a suspected drunk driving crash is determining where the driver obtained alcohol. Texas law makes it illegal for alcohol providers, such as bars and restaurants, to serve someone who is obviously intoxicated. If the driver had been overserved by an establishment before this incident, that establishment may share responsibility for what happened.
Dram shop laws in Texas are designed to hold alcohol providers accountable for their role in alcohol-related crashes. These laws not only help victims and their families seek justice but also encourage businesses to prioritize safe and responsible alcohol service. By doing so, they play a vital role in reducing the number of preventable accidents on our roads.
To fully understand what led to this crash, it’s essential that investigators look into the driver’s actions before the collision. If an alcohol provider overserved her, they should face the appropriate consequences. Accountability at every level is key to making Texas roads safer for everyone and ensuring that those who contribute to such incidents are held responsible.
