Commentary by Attorney Michael Grossman
Following any crash at 2:00 a.m., people are likely to have theories about alcohol's involvement. It's a shame people jump to such conclusions. Not every crash that happens at this time of night can be blamed on alcohol. For example, vehicle defects are more common than people realize, yet they rarely get proper attention because people would rather make assumptions than let the evidence speak for itself.
Unfortunately, even when alcohol is a factor, hasty assumptions can still prevent a grieving family from getting the answers they deserve. Even authorities can drop the ball when they suspect alcohol because they just fill in the blanks with their own preconceptions. As a result, mistakes happen, and families can be left wondering if story they're actually getting the whole story.
Across hundreds of alcohol-related accidents our firm has helped families with, for example, it would shock people to see how many times authorities simply took blood tests, said the victim was drunk, and then closed the case there. Then, when we dug deeper, it turned out authorities overlooked something crucial, like a local business who broke the law and over-served the victim. When they could have already been filing charges, they instead washed their hands of the ordeal and left the victim's loved ones to seek out answers on their own. Not only that, but had there not been someone to pick up the slack, those businesses would avoid consequences and just keep putting the community at risk until more families suffered similar fates.
That's why I comment on accidents like this one. Civilians and authorities alike have many biases, and it can lead to all kinds of important details slipping through the cracks. Whatever ultimately led to the crash, the important thing is knowing that the facts are telling the story, not baseless conjecture.
