Commentary by Attorney Michael Grossman
A common misconception I encounter is people who think authorities automatically have crack CSI teams look into crashes and get extensive evidence about what happened. In reality, I deal with cases all the time where authorities either jumped to conclusions or simply moved on to other responsibilities before they could really gather clear evidence. That's why it's often important to follow up with authorities and make sure they're on the ball.
Did they pull vehicle data? Did they obtain cell phone records? Have they looked at nearby traffic cameras or security cameras at nearby businesses or residences? Did they test for alcohol? Have they examined the vehicles for defects? Is the road itself defective or lacking signage or lighting? Was this all the result of a medical emergency? Has there been a reconstruction of the crash, including laser mapping and debris analysis?
Sometimes, authorities have clear answers to all of these questions. Other times, they might as well be empty handed. Either way, simply being diligent and proactive can help victims and families ensure their accident gets the attention it deserves. Whether or not that happened here remains to be seen.
