Juan Gutierrez Gutierrez Killed, 2 Injured in Car Accident in Irving, TX
Irving, TX — March 2, 2024, Juan Gutierrez Gutierrez was killed and two were injured due to a car versus pedestrian accident at 11:35 p.m. on Highway 114.
According to initial details about the accident, the crash took place along eastbound lanes of the John Carpenter Freeway near Freeport Parkway.

Officials said that 36-year-old Juan Gutierrez Gutierrez was involved in an initial crash which left the Nissan Altima he was in disabled in traffic lanes. Minutes later, according to investigators, Gutierrez and two other men were outside the Nissan attempting to push it out of the roadway. While doing so, a Toyota Camry crashed into the Nissan.
Gutierrez was hit in the process of the collision, and Gutierrez sustained fatal injuries. The other two men pushing the vehicle reportedly had moderate injuries. It's unclear if anyone else was hurt. Right now, factors surrounding the crash remain unconfirmed.

While I can't offer any specific information on this crash, incidents like this typically come down to a key factor: was the disabled vehicle reasonably avoidable?
Simply put, if a driver can see an obstacle and has enough time to avoid it, they have a responsibility to do so. A driver failing to avoid a reasonably avoidable collision would raise red flags. However, if a reasonably prudent driver couldn't have seen and avoided the obstacle, then it would be ridiculous to blame someone for a crash they couldn't avoid. Finding out whether or not the disabled vehicle here was well lit, for example, could offer valuable insight into how avoidable this crash was.
As simple as this seems, it would surprise folks how often crashes like this can slip through the cracks. If authorities feel they have other priorities to move on to, they may just write all of this off as an unavoidable tragedy. But it's up to the evidence to say whether or not that's true.
