Jose Gallegos Killed in Work Accident in Karnes City, TX
Karnes County, TX — May 24, 2024, Jose Gallegos was killed as the result of a work accident that happened at around 4:30 p.m. off F.M. 1144.
Authorities said in a preliminary Occupational Safety and Health Administration investigation summary that the accident happened west of Karnes City off the corner of F.M. 1144 and County Road 349.
According to officials, Jose Gallegos was working at a drill site at the time. While details have yet to be confirmed, OSHA says that Jose Gallegos may have died a the result of heat exposure. Another worker was reportedly taken to a hospital.
The OSHA summary did not give any additional details about the accident. Other details are unavailable.
Commentary
While there isn't a lot of information available about this accident, experience has shown me that one thing remains consistent between fatal work accidents. Texas has the most complex work fatality laws of any other state in the country. Despite what people may think, there is not always a guaranteed path to getting a family the benefits they need following an accident. Not only that, but when there is a path for those benefits, they can act more like constraints unless there is clear evidence an employer's egregious behavior contributed to the accident. Ultimately, this leads to a complex legal maze that requires extensive experience and legal strategizing to navigate. The sooner steps are taken to ensure a worker's family has access to those resources, the sooner they can work toward a fair resolution.
