Commentary by Attorney Michael Grossman
When accidents like this occur, they often raise more questions than answers. While many may quickly conclude that a swerve into the opposing lane was the sole factor in the crash, my years of experience in commercial vehicle cases suggest a more complex picture is often at play. Understanding the circumstances that caused Norton Segarra’s vehicle to cross into oncoming traffic is essential to determining whether this tragedy could have been prevented.
Key to any investigation will be examining the moments leading up to the collision. Why did Segarra's vehicle veer into the opposing lane? Was there an external factor, such as a sudden obstacle or another vehicle's actions? Was the driver affected by a distraction or medical issue? Similarly, it’s important to scrutinize the 18-wheeler’s role in the crash. Did the truck driver have enough time and space to react appropriately? While the reports don’t suggest fault on the part of the truck driver, that cannot always be assumed without further evidence.
Investigators should also evaluate the 18-wheeler itself. Was the truck properly maintained? Defective brakes, worn tires, or other mechanical failures can significantly hinder a driver’s ability to respond to sudden changes in traffic. These factors are often tied to the trucking company’s responsibility to ensure its vehicles are in roadworthy condition.
The trucking company’s practices and oversight warrant a closer look as well. Companies are responsible for ensuring their drivers are well-trained and able to handle sudden emergencies. Were the truck driver’s actions consistent with proper defensive driving techniques? Did the company enforce safety policies to minimize risks on the road? These are questions that could shed light on whether all reasonable precautions were taken to avoid this collision.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure clarity and closure for those impacted by this incident.
