Commentary by Attorney Michael Grossman
When I see reports of a crash like this, my first thought is that the driver’s loved ones deserve clear answers about what happened. A fatal two-vehicle collision at an intersection raises important questions, and in my experience, these cases are often more complex than they appear at first glance. Before any conclusions can be reached, three key areas need further investigation.
First, did authorities conduct a thorough investigation? Intersection crashes often happen quickly, making it critical to determine which vehicle had the right of way. Did investigators confirm whether traffic signals were functioning properly and clearly visible to both drivers? Were there any obstructions, poor lighting or road design flaws that may have contributed to the crash? Additionally, authorities should look into whether either driver had enough time and space to avoid the collision. A proper reconstruction of the scene is necessary to ensure all contributing factors are considered.
Second, has anyone looked into whether a vehicle defect contributed to the crash? The Chevrolet Impala involved in this accident is a 25-year-old vehicle, making mechanical failure a real possibility. Did the brakes, steering or throttle malfunction, preventing the driver from making a safe turn? Was there an issue with the vehicle’s lights, reducing visibility? Additionally, given the severity of the crash, did the Impala’s crashworthiness systems — such as seat belts and airbags — function as expected? A forensic inspection of the vehicle is essential to rule out mechanical failures that could have contributed to the outcome.
Finally, has all available electronic data been collected? While the 2000 Chevrolet Impala may not have extensive onboard data storage, the 2022 Volkswagen Arteon likely has an engine control module (ECM) that records key information such as speed, braking and steering inputs before impact. Retrieving this data could provide valuable insight into whether either driver attempted to avoid the crash. Additionally, any nearby traffic or surveillance cameras may have captured footage of the vehicles leading up to the collision. Phone records should also be reviewed to determine if distraction played a role.
At the end of the day, a man lost his life in this crash, and his family deserves to know exactly what happened. A full and thorough investigation is the only way to ensure that no key details are overlooked. If any of these three questions remain unanswered, the family simply doesn’t have the full story.
