Jose Mendez Jr., 1 Injured in Alleged Drunk Driver Accident in McAllen, TX
McAllen, TX — March 29, 2025, Jose Mendez Jr. and one other were injured following an alleged drunk driver accident at midnight on Auburn Avenue.
Preliminary information about the accident says that it took place off the intersection of Auburn Avenue and Ware Road.

According to investigators, 50-year-old Jose Luis Mendez Jr. was in a Chevy Silverado going westbound. A Dodge Ram was going eastbound. Reports say that the Dodge failed to stay in its lane, and it crashed into Mendez's vehicle.
Due to the collision, Jose Mendez was seriously injured. The Dodge driver had minor injuries. Authorities allege that the Dodge driver was under the influence of alcohol at the time. They recommended a charge for intoxication assault.
Commentary
If the allegations here are true, then people may see this all as open-and-shut. After all, authorities recommended charges against the alleged drunk driver. However, there could be an accomplice to all of this who also needs to be held accountable: a negligent alcohol provider.
In Texas, bars and other establishments who over-serve someone that is obviously intoxicated are breaking the law. Doing so can expose them to potential consequences, including fines and liability for the injuries caused by that intoxication.
Too often, though, this goes overlooked. I've handled hundreds of cases involving drunk drivers, and authorities tend to get tunnel vision, putting all of their focus on the alleged drunk drivers. Meanwhile, there could be a reckless alcohol provider who contributed to the crash still putting the community in danger.
That's why I have to wonder if authorities have been thorough enough here to look into where this alleged drunk driver got their alcohol from. Maybe this all was just the result of one reckless driver, but in my experience, there's usually a series of mistakes that lead to accidents like this one. If nothing else, that should at least be ruled out.
