Commentary by Attorney Michael Grossman
Crashes that leave one vehicle overturned and a driver fatally injured often raise more questions than they answer. And until those questions are addressed with real investigative depth, the causes behind the crash stay unclear.
1. Did the authorities thoroughly investigate the crash?
When two vehicles collide and one ends up on its roof, the physical forces involved are significant—and understanding how it happened takes more than a glance at the damage. Investigators should be looking closely at the point of impact, angles of approach, and whether either vehicle made sudden maneuvers before the collision. A rollover often indicates instability or a side impact, both of which should be carefully reconstructed. It’s also important to consider whether the investigating team had the right tools and expertise to analyze those dynamics properly.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
If one of the vehicles flipped, it’s fair to ask whether something within the vehicle failed—like suspension components, steering systems, or even rollover sensors. Sometimes, it's a combination of driver input and mechanical limitations that leads to a rollover, especially in vehicles with a high center of gravity. Without a mechanical inspection, it’s impossible to rule out defects that may have worsened the outcome or contributed to the crash in the first place.
3. Has all the electronic data relating to the crash been collected?
To understand how the collision unfolded, vehicle data is key. Speed, braking, and steering input can show who was reacting and how forcefully. Paired with GPS or camera footage, this information helps piece together the critical seconds before the crash. It’s also worth checking mobile data to rule out distraction, particularly when the cause is still being described as “unknown.”
When a crash results in a death, the priority should always be clarity—not assumptions. Getting the facts right requires asking hard questions and following the evidence, even when it points in unexpected directions.
Takeaways:
- Rollover crashes must be reconstructed to understand what forces caused the flip.
- Vehicle defects might make a crash worse or even initiate it.
- Speed, steering, and GPS data help explain how the crash unfolded.
