Commentary by Attorney Michael Grossman
When a vehicle is found traveling in the wrong direction on a highway, and the outcome is as severe as a multi-fatal collision followed by fire, the need for answers becomes urgent. Crashes like this don’t just happen without cause—they unfold from a chain of decisions, failures, or malfunctions that must be unraveled piece by piece.
1. Did the authorities thoroughly investigate the crash?
A wrong-way entry onto a highway raises immediate concerns about how the Jeep ended up in that position. Investigators should be asking whether the entry point was clearly marked, but more importantly, they must examine the full timeline of the vehicle’s movements: How far did it travel? Was there any attempt to correct course? Reconstructing these events takes more than routine reporting—it requires mapping vehicle trajectories, reviewing surveillance footage, and interviewing any witnesses who saw the vehicle before impact. Anything less leaves a major gap.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
While driver error is often assumed in wrong-way scenarios, mechanical issues can’t be ignored. A stuck steering system, brake failure, or electronic navigation error could have played a role. Additionally, the post-collision fires demand their own scrutiny. Fuel system integrity and battery performance—especially in high-heat crashes—should be inspected closely. Fires following impact aren’t always random; sometimes they point to design flaws or maintenance failures that warrant a deeper look.
3. Has all the electronic data relating to the crash been collected?
Both the Jeep and the Hyundai may hold vital information about what led up to the impact. Speed, brake use, steering inputs, and even navigation system data could offer key insights. GPS history might show where the Jeep began its wrong-way travel. If onboard systems, phones, or traffic cameras near the entry ramp captured any of the lead-up, those records need to be preserved and reviewed thoroughly. Otherwise, the most critical details could remain unanswered.
When five lives are lost in a single incident, every possible explanation should be on the table from the beginning. Assumptions won’t bring clarity—but asking the right questions just might.
Takeaways:
- Wrong-way collisions require full review of how the vehicle entered and traveled the roadway.
- Mechanical issues and fire causes should be examined with detailed inspections.
- Vehicle data and GPS history can clarify whether the driver was reacting—or unable to.
