Commentary by Attorney Michael Grossman
People tend to see train wrecks as open-and-shut considering there aren't many situation where the train does anything wrong. Obviously, the most common scenario is that the driver crossing the tracks is the one who made a mistake. But there are other possibilities to consider. Are there broken signals here? Is there a lack of signage? Have plants grown too much and are blocking the view of the crossing? Was the commercial vehicle disabled on the tracks, and the train operator failed to react in time? Was this the result of something highly unusual, like a vehicle defect? Likely or not, someone lost their life here. That warrants considering the crash from all angles.
