Commentary by Attorney Michael Grossman
When I read about incidents like this one, what stands out to me isn’t just what happened, but what’s missing from the conversation. A man was seriously hurt, and another driver was arrested on suspicion of driving while intoxicated. But in situations like this, very few people stop to ask: how did this person come to be in a position to drive?
One of the most important but often overlooked questions in cases like this is, “Where did the driver get their alcohol?” Texas law recognizes that when someone drinks to the point of clear intoxication, and is still served more, the business that provided that alcohol may share in the responsibility for what happened next. If an alcohol provider overserved the driver in this case, that’s not just a moral issue—it could be a legal one.
It may be surprising, but in many drunk driving crash investigations, authorities lack the resources and support necessary to investigate where the alleged drunk driver was drinking prior to the crash. Without that step, important answers can go missing. The law offers tools to uncover the full picture, but only if someone knows to look.
When I reflect on incidents like this, I’m reminded how easily a critical piece of the story can be overlooked. If alcohol played a role, the real question isn’t just whether the driver was impaired—but whether someone else made it possible.
Key Takeaways:
- Dram shop law allows those harmed by drunk driving to investigate whether an alcohol provider overserved the driver.
- A full investigation should include where and how the driver obtained their alcohol.
- Legal options may exist even if families aren’t initially aware of them.
