Commentary by Attorney Michael Grossman
When someone suffers serious injuries in a crash and authorities suspect alcohol may have been involved, it’s important to take a step back and look at the bigger picture. In this case, while intoxication hasn’t been confirmed, officials say the driver who allegedly caused the collision may have been drinking. That alone warrants a deeper look—not just at the moment of impact, but at what led up to it.
Texas law makes it clear: alcohol providers aren’t allowed to serve someone who is obviously intoxicated. If further investigation shows that alcohol did contribute to this crash, the question becomes whether a bar, restaurant, or other provider over-served the driver beforehand—and whether that decision put others on the road at risk.
Those are questions that rarely get answered unless someone pushes for them. Police typically focus on crash mechanics, not where a driver was drinking or how impaired they appeared when they were last served. That’s why dram shop law exists—to help fill in those gaps and ensure all forms of accountability are considered.
Key takeaways:
- Authorities suspect alcohol may have been involved, though it hasn’t been confirmed.
- If alcohol did play a role, identifying where the driver was drinking could be crucial.
- Texas dram shop law exists to hold alcohol providers accountable when over-service leads to harm.
