Commentary by Attorney Michael Grossman
As straight-forward as these details may seem, there really aren't any open-and-shut motorcycle accidents. The unfortunate reality is a lot of people are more likely to blame motorcyclists, and insurance companies know this. As a result, a lot of motorcyclists or their families find themselves dealing with all kinds of blame-shifting and mudslinging as the insurance companies try their best to shift the focus onto the victim.
This can be overcome, of course—I've had to do it countless times. However, it takes a lot more clear and convincing evidence and legal strategy than what typical police reports delve into. That's why a lot of motorcycle accidents end up better off with independent accident reconstructionists looking things over. The less room there is for speculation, the less room there is for blame-shifting.
