Commentary by Attorney Michael Grossman
When someone on foot is seriously hurt in a traffic collision, it tends to shake our assumptions about safety in everyday moments. Crossing the street shouldn’t carry such heavy risk. These incidents often raise tough questions about what really happened, and too often, the answers don’t get the scrutiny they deserve.
Did the authorities thoroughly investigate the crash? Pedestrian-involved collisions are complex, and understanding them requires more than just measuring skid marks and writing down statements. The key is whether investigators took steps to fully reconstruct the sequence of events: using tools like scene mapping, vehicle positioning and timeline reconstruction to establish how and why contact occurred. That kind of analysis can reveal if the driver had time to react or whether they were alert in the moments leading up to the crash. Unfortunately, not every investigative unit has the training or resources to go that far, and the difference in quality from one department to another can be significant.
Has anyone looked into the possibility that a vehicle defect caused the crash? Even when human error seems like the obvious explanation, no serious investigation is complete without verifying the vehicle itself was functioning properly. In a case like this, where a newer model SUV was involved, the electronic safety systems should be thoroughly checked. Did automatic emergency braking activate as designed? Was there a sensor malfunction or delay? These aren’t visible issues. They require specific diagnostics and mechanical inspection. Skipping that step can leave critical questions unanswered.
Has all the electronic data relating to the crash been collected? Most modern vehicles, especially recent SUVs like the one mentioned here, contain a wealth of crash-related data: speed, braking force, steering input and even collision alerts. When a pedestrian is hit, that kind of data can confirm whether the driver made any evasive moves or applied the brakes at all. It’s equally important to gather phone records and possible traffic cam footage from the area. These tools bring clarity to situations where eyewitness accounts may be limited or inconsistent.
When someone ends up in the hospital after a crash like this, it’s not enough to rely on surface-level answers. A serious investigation looks beyond the obvious and takes the time to get it right.
Key Takeaways:
- Not all crash investigations go deep enough to reveal key facts about what happened.
- Vehicle defects, including sensor or braking issues, must be checked even when there’s no obvious sign of failure.
- Data from the SUV and nearby cameras could help confirm whether the driver reacted in time.
